1. Agreement to Terms

By accessing or using Scrape Radar ("Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you disagree with any part of these Terms, you do not have permission to access the Service.

These Terms constitute a legally binding agreement between you and Scrape Radar ("Company," "we," "our," or "us").

2. Service Description

Scrape Radar provides AI-powered web scraping and data extraction services. The Service allows users to create prompts that extract structured data from websites using automated tools and artificial intelligence.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time without prior notice.

3. Account Registration

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the security of your account credentials
  • You must be at least 16 years old to use the Service
  • One person or entity may not maintain multiple free accounts
  • You are responsible for all activities that occur under your account

4. Acceptable Use Policy

You agree NOT to use the Service to:

  • Violate any applicable laws, regulations, or third-party rights
  • Scrape websites that prohibit scraping in their terms of service or robots.txt
  • Collect personal data without proper legal basis or consent
  • Circumvent access controls, authentication, or security measures
  • Overload, damage, or impair target websites or our infrastructure
  • Collect data for unlawful purposes, harassment, or harm
  • Resell or redistribute the Service without authorization
  • Transmit malware, viruses, or malicious code
  • Attempt to reverse engineer or extract source code from the Service
  • Scrape content protected by copyright without authorization

We reserve the right to suspend or terminate accounts that violate this policy without refund.

5. User Responsibilities

You are solely responsible for:

  • Ensuring your use of the Service complies with all applicable laws
  • Verifying that scraping target websites is legally permitted
  • Obtaining any necessary consents or authorizations for data collection
  • The content of your prompts and how you use extracted data
  • Complying with GDPR and other data protection regulations when collecting personal data
  • Respecting intellectual property rights of website owners

We provide the technical capability to scrape websites but make no representations about the legality of scraping any particular website.

6. Credits, Payments, and Refunds

6.1 Credits

  • The Service operates on a credit-based system
  • Purchased credits do not expire (except as stated at purchase)
  • Credits are non-transferable between accounts

6.2 Payments

  • All payments are processed securely through Paddle
  • Prices are displayed in your local currency where available, or in EUR/USD
  • All prices include applicable VAT where required by law
  • You agree to pay all charges at the prices in effect when incurred
  • We reserve the right to change pricing with 30 days notice

6.3 Right of Withdrawal (EU Consumers)

If you are a consumer in the European Union, you have the right to withdraw from a purchase within 14 days without giving any reason. However, by purchasing credits and using the Service, you expressly consent to immediate performance and acknowledge that you lose your right of withdrawal once the digital content has been accessed or credits have been used.

To exercise the right of withdrawal before using credits, send a clear statement to support@scraperadar.com within 14 days of purchase.

6.4 Refunds

Refunds for unused credit packs may be requested within 14 days of purchase by contacting support@scraperadar.com. Once credits have been used, refunds are not available except where required by applicable consumer protection laws.

7. Intellectual Property

7.1 Our Property

The Service, including its original content, features, and functionality, is owned by Scrape Radar and protected by international copyright, trademark, and other intellectual property laws.

7.2 Your Content

You retain ownership of prompts you create and data you extract. You grant us a limited license to process your content as necessary to provide the Service.

7.3 Third-Party Content

We make no claim to ownership of data extracted from third-party websites. You are responsible for ensuring you have the right to use such data.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, TO THE EXTENT PERMITTED BY APPLICABLE LAW.

We do not warrant that:

  • The Service will be uninterrupted, secure, or error-free
  • Results will be accurate, reliable, or complete
  • Any particular website can be successfully scraped
  • The Service will meet your specific requirements

Scraping success depends on target website structure, which may change without notice. We are not responsible for failed scrapes due to website changes or access restrictions.

For EU Consumers: These disclaimers do not affect your statutory rights under applicable consumer protection laws, including the legal guarantee of conformity for digital content and services.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
  • We shall not be liable for any loss of profits, data, use, goodwill, or other intangible losses
  • Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim
  • We are not liable for any damages arising from your use of extracted data
  • We are not liable for actions taken against you by third parties (including website owners)

Nothing in these Terms excludes or limits our liability for:

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Any matter for which it would be unlawful for us to exclude or limit liability
  • Your statutory rights as a consumer under applicable EU law

10. Indemnification

You agree to defend, indemnify, and hold harmless Scrape Radar, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights, including website terms of service
  • Your violation of any applicable laws or regulations
  • Any claim that your use of the Service caused damage to a third party

11. Termination

We may terminate or suspend your account immediately, without prior notice, for any reason, including:

  • Breach of these Terms
  • Violation of the Acceptable Use Policy
  • At our sole discretion for any other reason

Upon termination, your right to use the Service ceases immediately. Unused credits may be forfeited upon termination for cause. Sections 7-10 survive termination.

12. Governing Law and Disputes

These Terms are governed by the laws of the European Union and the Member State where the Company is established, without regard to conflict of law principles.

For EU Consumers: If you are a consumer residing in the EU, you benefit from mandatory provisions of consumer protection laws in your country of residence. Nothing in these Terms affects your rights as a consumer to rely on such mandatory provisions.

You may bring legal proceedings in the courts of the Member State in which you are domiciled. We may only bring proceedings against you in the courts of the Member State in which you are domiciled.

Alternative Dispute Resolution: The European Commission provides an Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

CLASS ACTION WAIVER: To the extent permitted by applicable law, you agree to resolve disputes individually and waive any right to participate in class action lawsuits or class-wide arbitration.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes via email or through the Service. Your continued use after changes constitutes acceptance. If you do not agree to modified Terms, you must stop using the Service.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Scrape Radar regarding the Service and supersede all prior agreements.
